Welcome!

We've drafted these Terms of Service (the "Terms") so you'll know the rules that govern your relationship with us as a user of Castle. These Terms apply to your use of our website, app, and any related services provided by Monterey's Coast, Inc. ("Castle"). They form a legally binding contract between you and Castle, so please read them carefully.

By using any of our Services, you agree to the Terms. If you don't agree, you must not use the Services.

ARBITRATION NOTICE: THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER. EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED IN THE ARBITRATION SECTION, YOU AND CASTLE AGREE THAT ALL DISPUTES BETWEEN US WILL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION. YOU MAY OPT OUT OF ARBITRATION AS DESCRIBED BELOW.

You can review the most current version of the Terms of Service at any time at: https://castle.xyz/terms. We may revise these Terms from time to time. If we make material changes, we will provide you with reasonable notice (unless changes are required sooner, for example, as a result of a change in legal requirements or where we are launching new Services or features). If you continue to use the Services once the changes come into effect, we will take that as your acceptance.

For information about how we collect, use, share, and store your data, please review our Privacy Policy, which forms part of these Terms.

Additional Terms. Certain products, programs, and features are subject to additional terms, rules, disclosures, or policies that we make available to you when you access or use them, including the Castle Creator Payout Program Terms, subscription offer terms, purchase disclosures, refund policies, promotion rules, and rules displayed on applicable product pages (collectively, "Additional Terms"). The Additional Terms are incorporated into these Terms. If these Terms conflict with Additional Terms, the Additional Terms will control solely with respect to the applicable product, program, or feature.

Castle expects all users to follow these Terms. Violations may result in the termination of your account. While Castle prohibits certain types of conduct and content, we do not control or actively monitor all content on the Service. You understand and agree that you may be exposed to materials you find offensive or inappropriate, and that you use the Service at your own risk.

In Summary: These Terms are your agreement with Castle. If you use Castle, you're agreeing to them. If you don't agree, don't use the Service. Sometimes we'll update these Terms, and if the changes are material we'll let you know when we do.


A. Account Terms

  • You may use the Service only if you can form a legally binding agreement with Castle or if your use is authorized by your parent or legal guardian where required by applicable law. If you are a parent or guardian and you allow a minor to use the Service, you agree that the minor’s use is subject to these Terms and that you are responsible for the minor’s use of the Service to the extent permitted by law. If we learn that an account belongs to a child for whom additional legal requirements apply, we may request parental consent, limit functionality, restrict access, delete personal information, or delete or disable the account as required or permitted by law.
  • You must be a human. Accounts registered by "bots" or other automated methods are not permitted.
  • You must choose a username and provide a valid email address or phone number and any other information requested in order to complete the signup process.
  • Your login may only be used by one person - a single login shared by multiple people is not permitted.
  • You are responsible for maintaining the security of your account and password. Castle cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  • You are responsible for all Content posted and activity that occurs under your account (even when Content is posted by others who access your account).
  • You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright or trademark laws).

Accurate account information. If asked by Castle, you must provide accurate and current information about your age, country or region, and any other information Castle requests. You may not misrepresent your age or use another person's identity, tax information, payment method, or payout account.

Purchases by minors. You may make a purchase only if you are legally able to enter into the transaction or if your parent or legal guardian has reviewed and authorized the purchase. If you are a parent or legal guardian who permits a minor to use a payment method, you authorize Castle and its payment providers to charge that payment method for purchases made through the minor's account, subject to applicable law.

Payment authorization. When you provide or select a payment method, you represent that you are authorized to use it and authorize Castle, the applicable app store, and their payment processors to charge the amounts disclosed at checkout, including applicable taxes and recurring charges you expressly authorize.

Accounts are personal. You may not sell, assign, transfer, or commercially share your Castle account. Castle may treat activity occurring through your account as authorized by you, except where applicable law provides otherwise.

In Summary: You may use Castle if you can legally agree to these Terms or have any required parent or guardian authorization. Castle may take additional steps for certain accounts when required by child-safety or children’s privacy laws. No bots, no sharing accounts with other people, and you're responsible for what happens on your account.


B. Termination and Suspension

While we hope you remain a lifelong Castle user, you can terminate these Terms at any time if you do not agree with any changes we make to them, or for any other reason, by deleting your Castle account. After we complete a deletion upon your request, all of your Content will be permanently deleted from the Service. This information cannot be recovered once your account is deleted, though some limited copies may be retained for a short period in backups or as required by law.

We may restrict, terminate, or temporarily suspend your access to the Services if you fail to comply with these Terms, our Community Guidelines, or the law, for reasons outside of our control, or for any other reason. That means we may terminate these Terms, stop providing you with all or any part of the Services, or impose new or additional limits on your ability to use the Services. For example, we may deactivate your account due to prolonged inactivity, and we may reclaim your username at any time for any reason. While we'll try to give you reasonable notice beforehand, we cannot guarantee that notice will always be possible in all circumstances.

Where we restrict, terminate, or suspend your access to the Services for violation of our Terms or applicable law, we will notify you and provide an opportunity for you to appeal that decision as explained in Section N (Content Moderation and Reporting).

Before we restrict, terminate, or suspend your access to the Services, we will take into account relevant facts and circumstances apparent from the information available to us, depending on the underlying reason for taking that action. For example, if you violate our Terms or Community Guidelines we may consider the severity, frequency, and impact of the violations as well as the intention behind the violation. This will inform our decision whether to restrict, terminate, or suspend your access to the Services and, in the event of suspension, how long we suspend your access.

Termination or deletion of an account may result in loss of unused Bricks, digital items, subscription benefits, and unapproved Earned Bricks, as described in Sections C through F and the Creator Payout Program Terms. Account deletion may not cancel a subscription billed by an app store. Finally approved but unpaid Creator Fees remain governed by the Creator Payout Program Terms.

Regardless of who terminates these Terms, both you and Castle continue to be bound by Sections C, D, E, F, I, J, K, L, M, N, O, P, Q, and R (to the extent any provisions would, by their nature, survive termination).

In Summary: You can delete your account at any time. We can suspend, restrict, or terminate accounts for violations, inactivity, or other reasons. We'll try to give notice and you may appeal in some cases.


C. Purchases, Billing, and Taxes

1. Castle is the seller

Unless the applicable checkout identifies an app store or another third party as the seller or merchant of record, Castle is the seller and merchant of record for purchases of Bricks, Castle Dweller, digital items, and other paid products or services offered through the Services.

When you purchase something from Castle, you are purchasing from Castle—not from another user or creator. A creator does not receive or hold your payment, is not a party to your purchase from Castle, and has no authority to provide you with a refund or make commitments on Castle's behalf.

2. Payment processing

Castle may use third-party payment processors, app stores, and billing providers to process purchases. You authorize Castle and the applicable provider to collect and process payment and transaction information as necessary to complete your purchase, prevent fraud, provide customer support, and comply with law.

A payment provider's separate terms and privacy practices may apply to its services. The involvement of a payment provider does not make another Castle user or creator the seller of anything you purchase from Castle.

3. Prices, currency, and taxes

The price, billing currency, billing period, and material terms of a purchase will be disclosed before you complete a transaction. Prices may vary based on country, currency, platform, taxes, app-store fees, promotions, and other factors.

You are responsible for applicable sales, use, value-added, goods and services, or similar transaction taxes that Castle is required or permitted to collect. Castle may calculate and collect taxes based on the information available to Castle or its providers.

Castle may change prices prospectively. A change to the price of an automatically renewing subscription will apply only as described in Section E and after any notice required by applicable law.

4. Receipts and transaction records

Castle or the applicable payment provider may send you a receipt or make transaction information available through your account. You should review transactions and promptly notify Castle of suspected unauthorized activity or material errors.

5. Refunds

Except as required by applicable law or expressly stated in a Castle refund policy or purchase disclosure:

  • purchases are final and nonrefundable;
  • Bricks and digital items are not refundable merely because you did not use them, changed your mind, lost access because of your own violation, or no longer want them; and
  • Castle does not provide partial-period or prorated refunds for a canceled subscription, though app stores may do so at their discretion.

Nothing in these Terms limits any non-waivable refund, cancellation, withdrawal, or conformity rights you have under applicable law.

6. Payment reversals and chargebacks

Castle may reverse a transaction, remove Bricks or digital items, cancel benefits, withhold a related credit, or suspend an account when:

  • the transaction is canceled, refunded, reversed, or charged back;
  • the payment was unauthorized or fraudulent;
  • Castle credited the wrong account or amount;
  • the transaction resulted from a technical error; or
  • reversal is required by law or a payment provider.

Castle may suspend accounts associated with fraudulent, abusive, or bad-faith chargebacks. Castle will not apply this provision to penalize a user for exercising a legal right to dispute an unauthorized or unlawful charge.

7. Purchases through app stores

Purchases made through an app store or other third-party storefront may also be governed by that provider's terms. The provider may control billing, cancellation, and refund processing.

Deleting a Castle account may not automatically cancel a subscription billed by an app store. You must cancel an app-store subscription through the applicable app-store account unless Castle expressly tells you otherwise.

In Summary: When you buy Bricks, Dweller, or another paid Castle product, you are buying it from Castle or the storefront identified at checkout—not from a creator.


D. Bricks and Digital Items

1. What Bricks are

"Bricks" are a digital feature that Castle may make available for use within the Services. Bricks are not money, legal tender, cryptocurrency, a deposit account, a payment account, a security, or a stored cash balance.

Except for the limited Creator Payout Program described below, Bricks have no cash value, do not accrue interest, and are not redeemable or exchangeable for money, monetary value, or property outside the Services.

2. Bricks are licensed, not sold

When you acquire Bricks, Castle grants you a limited, personal, revocable, nonexclusive, nontransferable license to use them solely through the Services and only for purposes Castle permits.

You do not acquire ownership of Bricks. Bricks are not your personal property, and acquiring Bricks does not create a bank, custodial, trust, fiduciary, or debtor-creditor relationship between you and Castle.

3. Purchased Bricks and Earned Bricks

Castle may distinguish between:

  • "Purchased Bricks," meaning Bricks made available because you or another authorized person purchased them from Castle or an applicable storefront; and
  • "Earned Bricks," meaning Bricks that Castle provisionally designates as earned by an eligible creator based on qualifying creator activity under the Creator Payout Program.

Purchased Bricks are never eligible for cash-out by the purchaser. Castle's records determine whether particular Bricks are Purchased Bricks, Earned Bricks, promotional Bricks, or another category.

Castle may display different categories in a combined balance, but combining them for display does not change their source or eligibility.

4. Using Bricks

Castle may permit you to use Bricks to access, activate, acquire, or interact with digital content, features, experiences, or other functionality provided through the Services, including functionality associated with content contributed by creators.

5. No user-to-creator transfer

When you use Bricks in connection with content created by another user, such as passes:

  • you are using a Castle feature or obtaining digital content or functionality from Castle;
  • you do not send or transfer Bricks, money, or other property to the creator;
  • the creator does not become the seller, merchant of record, or payment recipient for your transaction;
  • no payment, agency, employment, partnership, or contractual relationship is created between you and the creator; and
  • Castle may, but is not required to, separately use the activity as one factor in determining whether to credit the creator with Earned Bricks or pay Creator Fees.

Any Earned Bricks Castle credits to a creator are a separate Castle accounting entry. They are not the same Bricks the user used, and they do not represent user money held for the creator.

6. Digital items and entitlements

Digital items, benefits, access rights, and other virtual content obtained through Castle are licensed, not sold. They may be usable only through the Services and may be subject to technical, account, geographic, age, or platform restrictions.

Unless Castle expressly permits it, you may not sell, transfer, sublicense, trade, rent, pledge, or exchange Bricks or digital items, operate a secondary market for them, or use them in an off-platform transaction.

7. Changes, errors, and reversals

Castle may correct errors and adjust Brick balances or digital entitlements when reasonably necessary to address fraud, unauthorized activity, refunds, chargebacks, abuse, duplicate credits, technical errors, violations of these Terms, or legal requirements.

Castle may change how Bricks or digital items work, what they can be used for, or the number required for a feature. Where required by applicable law, Castle will provide advance notice or an appropriate remedy before making a material adverse change to previously purchased and unused digital value.

8. Account suspension or closure

If your account is suspended or closed, you may lose access to unused Bricks and digital items. No refund or payment will be due except where required by law, expressly provided by Castle's refund policy, or owed under an approved Creator Payout Request.

Castle will not use this provision to eliminate an obligation to pay Creator Fees that Castle has finally approved, except where the approval resulted from fraud, material misrepresentation, duplicate payment, technical error, or another adjustment expressly permitted by the Creator Payout Program Terms.

9. No guaranteed availability or value

Castle does not guarantee that Bricks, any Brick use, any digital item, or any particular creator feature will always remain available. Castle does not guarantee that Bricks will retain any particular functionality or exchange power within the Services.

The possibility that an eligible creator may receive Creator Fees calculated by reference to Earned Bricks does not give Bricks cash value and does not permit ordinary users to redeem Purchased Bricks.

In Summary: Bricks are a licensed Castle feature for use on Castle. They are not cash, and using Bricks does not transfer money or property to another user.


E. Castle Dweller

1. Subscription benefits

"Castle Dweller" or just "Dweller" is a paid subscription providing the benefits described when you subscribe. Dweller is a Castle subscription for the subscribing user. Dweller fees do not belong to, and do not create an entitlement for, any creator.

Castle may add, modify, replace, or discontinue Dweller benefits. If Castle materially reduces a paid subscription during an already-paid billing period, Castle will provide any notice, cancellation right, refund, or other remedy required by applicable law.

2. Automatic renewal

CASTLE DWELLER AUTOMATICALLY RENEWS UNTIL CANCELED.

When you purchase Dweller, you authorize Castle or the applicable app store to charge the disclosed subscription price, applicable taxes, and any disclosed fees at the beginning of each billing period until the subscription is canceled.

The checkout screen will disclose whether your plan renews monthly, annually, or on another interval, along with the price and material renewal terms.

3. How to cancel

You may cancel Dweller at any time through:

  • the subscription controls in your Castle account, for subscriptions billed directly by Castle; or
  • the applicable app-store or storefront subscription controls, for subscriptions billed by that provider.

Cancellation takes effect at the end of the current paid billing period unless applicable law or the applicable storefront provides otherwise. You will generally retain access to Dweller benefits through that date.

To avoid the next charge, you must cancel before the renewal date shown in your account or by the applicable storefront. When handled by Castle, Castle will provide a cancellation method that is reasonably easy to find and use.

4. Refunds

Except as required by law or stated in a specific refund policy, canceling Dweller stops future renewals but does not generate a refund or prorated credit for the current billing period.

5. Price changes

Castle may change the price of Dweller for future billing periods. Castle will provide advance notice required by applicable law before a price increase applies to your subscription.

A price change will not apply retroactively to a billing period already paid. Where applicable law requires your affirmative consent to continue at a new price, Castle will obtain that consent.

6. Trials and promotional offers

Where authorized by law, a trial or promotional subscription may automatically convert to a paid subscription if that was clearly disclosed and you expressly authorized the conversion. Before you enroll, Castle will disclose the trial length, the price following the trial, the renewal interval, and how to cancel.

Eligibility for a trial or promotion may be limited. Castle may revoke or correct a trial or promotional benefit obtained through fraud, abuse, duplicate accounts, or technical error.

7. Failed payments

If Castle cannot process a renewal payment, Castle may retry the payment as permitted by the payment provider, suspend Dweller benefits, or cancel the subscription. You remain responsible for charges validly incurred before cancellation.

8. Mandatory consumer rights

Nothing in this Section limits non-waivable cancellation, renewal, refund, withdrawal, or digital-content rights available under applicable law.

In Summary: Dweller renews and charges you automatically until you cancel. The price, renewal period, and cancellation method will be shown before you subscribe.


F. Creator Payout Program

Castle may offer eligible creators an opportunity to receive fees from Castle for services and contributions they provide to Castle.

Participation is governed by the Castle Creator Payout Program Terms, which are incorporated into these Terms. Castle may require age verification, parent or guardian participation, identity verification, tax documentation, payment-provider onboarding, a minimum Earned Brick balance, continuing account compliance, and satisfaction of other eligibility requirements.

Purchased Bricks cannot be cashed out. A creator's opportunity to receive Creator Fees is based only on qualifying Earned Bricks and is subject to Castle's review and approval under the Creator Payout Program Terms.

A user's purchase or use of Bricks does not create a direct payment obligation from that user to a creator. Castle alone determines whether creator activity qualifies, whether Earned Bricks will be credited, and whether a Payout Request will be approved, subject to the Creator Payout Program Terms and applicable law.

In Summary: Creator payouts are separate payments Castle may make for creator services. Users do not pay or transfer Bricks directly to creators.


G. Recommendations and Personalization

Castle may personalize recommendations, featured content, search results, or other content presented through the Services using information such as gameplay history, interactions, subscriptions, popularity, account activity, and similar signals. Castle may modify the factors used by its recommendation systems over time to improve the Services.


H. Modifications to the Service and Prices

Castle reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

Castle shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.

Changes to the price of an automatically renewing subscription apply only to future billing periods and are subject to the notice, consent, and cancellation requirements in Section E and applicable law.

In Summary: Castle may change or discontinue parts of the Service at any time.


I. Copyright and Content Ownership

We claim no intellectual property rights over the material you provide to the Service. Your profile and materials uploaded remain yours. However, by setting your decks to be viewed publicly, you agree to allow others to view your Content.

By uploading or otherwise making Content available on the Service, you grant Castle a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Service and Castle's (and its successors' and affiliates') business.

Except as expressly provided in the Creator Payout Program Terms or another signed agreement with Castle, submitting or publishing User Content does not entitle you to payment, royalties, revenue sharing, or other compensation. Creator Fees paid under the Creator Payout Program are consideration for applicable Creator Services and the rights granted under these Terms.

Castle and its designee have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available via the Service.

You shall defend, indemnify, and hold harmless Castle against any claim, demand, suit, or proceeding made or brought against Castle by a third party alleging that Your Content or Your use of the Service in violation of this Agreement infringes or misappropriates intellectual property rights or violates applicable law.

If you provide feedback, suggestions, or ideas about Castle or the Service, you agree that Castle may use them without restriction or obligation to you, and without any compensation.

You may not duplicate, copy, or reuse any portion of the Castle mobile applications without express written permission from Castle.

In Summary: You own your content but give Castle a license to use it to run the Service. You're responsible if your content breaks the law. If you give us feedback, we can use it without owing you anything.


J. DMCA Takedown Policy

Castle respects the intellectual property rights of others and complies with the provisions of the Digital Millennium Copyright Act ("DMCA"). If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please notify Castle's designated DMCA Agent with the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material that is claimed to be infringing or the subject of infringing activity and that is to be removed or access to which is to be disabled;
  • Information reasonably sufficient to permit Castle to contact you, such as an address, telephone number, and email address;
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

K. Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

You and Castle agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved solely through binding individual arbitration, except that either party may bring an individual action in small claims court or seek injunctive or other equitable relief for the alleged unlawful use of intellectual property.

Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in California unless the parties agree otherwise. The arbitrator's decision will be final and binding, and judgment may be entered in any court with jurisdiction.

Class and Representative Action Waiver
YOU AND CASTLE AGREE THAT ALL CLAIMS AND DISPUTES ARISING OUT OF OR RELATING TO THESE TERMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS AND NOT ON A CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL BASIS. CLAIMS OF MORE THAN ONE USER CANNOT BE ARBITRATED OR LITIGATED JOINTLY OR CONSOLIDATED WITH THOSE OF ANY OTHER USER. IF THIS WAIVER IS FOUND UNENFORCEABLE, THEN THE AGREEMENT TO ARBITRATE SHALL BE NULL AND VOID WITH RESPECT TO THAT PROCEEDING, AND THE CLAIM MUST BE BROUGHT IN COURT.

Opt-Out: You may opt out of arbitration by sending a written notice to support@castle.xyz within 30 days of accepting these Terms, stating clearly your intent to opt out of arbitration. Include your full name and username (if applicable) in the notice.

In Summary: Disputes will usually go to individual arbitration, not court. You can't bring or join class actions. You can opt out of arbitration within 30 days.


L. Software Restrictions

You may not:

  • Copy, modify, or create derivative works based on the Service;
  • Distribute, transfer, sublicense, lease, lend, or rent the Service to any third party;
  • Reverse engineer, decompile, or disassemble the Service;
  • Make the functionality of the Service available to multiple users through any means.

In Summary: Don't misuse Castle's software, copy it, or try to hack it.


M. Limitation of Liability

To the maximum extent permitted by law, Castle and its affiliates, officers, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Unauthorized access, use, or alteration of your content or transmissions.

In no event shall Castle's total liability exceed $100.

The foregoing cap does not limit Castle's obligation to pay Creator Fees that Castle has finally approved under the Creator Payout Program Terms, subject to permitted withholding, offsets, reversals, and adjustments.

Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Castle does not guarantee that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected.

In Summary: Castle isn't liable for most types of damages, and the Service comes "as is" with no guarantees.


N. Content Moderation and Reporting

Castle's Community Guidelines, available at https://castle.xyz/community_guidelines, form part of these Terms. You must follow the Community Guidelines when using the Service.

Castle may review, remove, or restrict content that violates these Terms or applicable laws, but is not obligated to do so.

Castle may remove or restrict access to content, reduce the visibility of content, suspend or terminate accounts, suspend participation in the Castle Creator Payout Program, or take other enforcement actions when we reasonably believe a user has violated these Terms, the Community Guidelines, the Castle Creator Payout Program Terms, or applicable law.

Castle may use automated tools together with human review to detect spam, fraud, abuse, policy violations, illegal content, or other activity that may violate these Terms or applicable law.

Users may report content or behavior that may violate these Terms, the Community Guidelines, or applicable law by using the in-Service reporting tools where available or by contacting support@castle.xyz.

When Castle removes content, restricts visibility of content, suspends or terminates an account, suspends participation in the Castle Creator Payout Program, or otherwise takes moderation action because of a violation of these Terms, the Community Guidelines, the Creator Payout Program Terms, or applicable law, Castle may notify the affected user of the action taken and the general reason for that action. Where required by applicable law, Castle will also provide information regarding available appeal or review procedures.

In Summary: Follow the Community Guidelines. We may remove content or suspend accounts, and you can report violations. In some cases, you'll get an explanation and the right to appeal.


O. Third-Party Services

The Service may contain links to or integrations with third-party websites, content, or services. Castle does not control and is not responsible for any third-party websites, content, or services. Your dealings with third parties are solely between you and the third party, and you agree that Castle is not liable for any loss or damage arising from such dealings.

Payout Providers may provide onboarding and payment-processing services, but Castle remains the contracting party responsible for initiating Creator Fees that Castle finally approves. A Payout Provider is not responsible for Castle's eligibility or calculation decisions.

In Summary: If you use third-party links or services through Castle, that's between you and them, not us.


P. Governing Law and Entire Agreement

These Terms of Service and your use of the Service are governed under California law. Nothing in these Terms affects your rights as a consumer under applicable mandatory law in your country of residence.

The failure of Castle to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. These Terms constitute the entire agreement between you and Castle and supersede any prior agreements between you and Castle regarding the Service.

In Summary: California law applies, but your mandatory consumer rights elsewhere still apply. This is the full agreement between you and Castle.


Q. Indemnity

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Castle, its affiliates, directors, officers, employees, licensors, and agents from and against any and all complaints, claims, damages, losses, costs, liabilities, and expenses (including reasonable attorneys' fees) due to, arising out of, or relating in any way to: (a) your access to or use of the Service, or any products or services provided by a third party in connection with the Service; (b) your Content, including claims that it infringes or misappropriates intellectual property rights or violates applicable law; (c) your breach of these Terms or any applicable law or regulation; or (d) your negligence or willful misconduct.

In Summary: If your use of Castle causes us legal trouble, you agree to cover our costs.


R. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. If any portion of the arbitration or class action waiver provisions is found unenforceable, the unenforceable portion shall be severed, and the remaining provisions enforced to the maximum extent permitted by law.

In Summary: If one part of these Terms is found to be invalid, the rest still applies.
